This RoadTech Connect (“RTC”) Privacy Policy describes how Express Distribution Solutions, LLC, a Florida limited liability company d/b/a RoadTech (“RoadTech,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information in connection with our websites, online store, RoadTech products, RoadTech Application (the “App”), RoadTech Connect platform, and related products and services (collectively, the “Services”).

This Privacy Policy is intended to serve as the primary privacy policy for our website, online store, RoadTech App, RoadTech TPMS system, RoadTech TPMS Connect system, RoadTech Connect system, RoadTech Connect platform, and related customer support, subscription, and connected services.

This Privacy Policy also includes and incorporates by reference the terms, conditions, policies, notices, and disclosures posted to the RoadTech Privacy Center located at [https://www.roadtechconnect.com/pages/privacy-center]. The RoadTech Privacy Center provides more detailed information about how RoadTech products collect and transmit vehicle data, how RoadTech connected services collect and use personal information, and how users may opt into or out of data sharing with RV OEMs and RV dealers.

Our Vehicle Data Transmission Policy [link] provides more detailed information about how RoadTech products collect and transmit data from your RV or light-duty trailer. 

Our Connected Services Policy [link] provides more detailed information about how we collect, use, and disclose personal information when you subscribe to RTC Services using the RoadTech App on your mobile device. Our Connected Services Policy also describes how the RoadTech Connect platform communicates with RoadTech products. 

Our Opt-Out of Data Transmission Policy [link] provides more detailed information about how to stop sharing certain RTC Unit Data and Sensor Data with RV OEMs and RV dealers. Each of those policies is incorporated into this Privacy Policy by reference.

If you access our website or online store at roadtechconnect.com, then this Privacy Policy applies to your interaction with our website and online store, including website browsing, customer purchases, order fulfillment, payment processing, marketing communications, and general customer support interactions.

Please read this Privacy Policy carefully. By using or accessing the Services, including by downloading, creating an account for, or using the App, you acknowledge that your personal information will be collected, used, disclosed, and otherwise processed as described in this Privacy Policy. Where required by applicable law, we will obtain your consent for specific collection, use, disclosure, or processing activities. If you do not agree to this Privacy Policy, please do not use or access the Services.

 

1.        Changes to This Privacy Policy

We may update or revise this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We reserve the right to modify this Privacy Policy at any time in our sole discretion. If we make material changes, we will post the revised Privacy Policy on the applicable website, App, or Privacy Center and update the “Last Updated” date. We may also provide notice by email, through the App, or by other means where required by applicable law. Your continued use of the Services after a revised Privacy Policy is posted constitutes your acknowledgement of the revised Privacy Policy, except where additional notice or consent is required by applicable law.

 

2.        Services Covered by This Privacy Policy

The products and services through which we may collect information include the RoadTech website and online store, RoadTech TPMS system, RoadTech TPMS Connect system, RoadTech Connect system, App, RoadTech Connect platform, customer support services, subscription services, and related communications.

 

RoadTech Website and Online Store

Our website and online store allow customers and prospective customers to learn about RoadTech products, purchase products or subscriptions, contact us, receive customer support, and interact with online content and forms. Our online store may be hosted or supported by Shopify or other third-party service providers.

 

RoadTech TPMS

Our RoadTech TPMS systems and RoadTech TPMS Connect systems provide real-time tire pressure and temperature monitoring for your RV or light-duty trailer. As described in our Vehicle Data Transmission Policy [link], the RoadTech TPMS systems and RoadTech TPMS Connect systems collect Sensor Data and may use your system’s MAC address to associate Sensor Data with your account. 

Depending on which product is used, certain data may remain local to your system or may be transmitted through the App or connected services.

 

RoadTech Connect

Our RoadTech Connect system provides location and health telematics for your RV or light-duty trailer. As described in our Vehicle Data Transmission Policy [link], the RoadTech Connect system has an RTC Unit ID and may collect RTC Unit Data and Sensor Data.

 

RoadTech App

The App is a mobile application for remote connection to RoadTech products. The App is subject to its own End User License Agreement, which may be viewed here [https://www.roadtechconnect.com/pages/roadtech-app-eula].

The App does not connect to the RoadTech TPMS system.  

However, you must use the App to use your RoadTech TPMS Connect system.  You may connect the App directly to the TPMS Connect Unit installed on your RV for initial installation and pairing, and set up a user account through the App to receive tire pressure data from your RoadTech TPMS Connect system. 

You may also connect the App directly to the RTC Unit for initial installation and pairing with your RoadTech Connect system.  In order to connect your RoadTech Connect system to the App through the RoadTech Connect platform, you will need to subscribe to the applicable RTC Services. Subscription may activate a cellular communication plan that allows transmission of RTC Unit Data and Sensor Data from your RTC Unit to our RoadTech Connect platform, which may then communicate data with your App.  RoadTech does not receive or store that data unless and until you connect the App to a RoadTech account, subscribe to RTC Services, or otherwise transmit the data to us.

If you subscribe to RTC Services, we may have access to your contact details, account information, subscription information, and certain product or vehicle-related information. We do not access or store complete payment card information. Payment information is processed by third-party payment processors, such as Stripe.

 

RoadTech Connect Platform

The RoadTech Connect platform provides a place for RV OEMs and RV dealers to track the health and sales performance of RVs and to communicate with RV owners who have chosen to share certain information with them. RV owners may access certain RoadTech Connect platform services by subscription using the App.

We do not provide RV owners with access to RoadTech Connect platform services through a web browser or API unless otherwise expressly made available by RoadTech.

 

3.        Children’s Privacy

The Services, including the App, are not intended for children under 18 years of age. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information through the Services, create an account, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username. If we learn that we have collected or received personal information from a child under 18 without appropriate consent, we will delete that information. If you believe we may have any information from or about a child under 18, please contact us at customerservice@roadtech.com.

 

4.        Personal Information We Collect

The personal information we collect depends on how you interact with the Services, the products you purchase or use, the features you enable, and the information you choose to provide.

 

Information You Provide Directly to Us

We may collect personal information that you provide directly to us, including:

·      Name, mailing address, billing address, email address, telephone number, and other contact information;

·      Account information, such as username or login ID, password, security questions, and other information used for account security purposes;

·      Subscription information, including subscription status, billing address, payment confirmation, and related transaction information;

·      Product registration information;

·      RV or vehicle information, such as VIN, make, model, year, dealer information, OEM information, and related product pairing information;

·      Customer support information, including records and copies of your correspondence, support requests, SMS messages, emails, and other communications with us;

·      Survey responses or feedback you choose to provide; and

·      Any other information you choose to submit through the website, online store, App, customer support channels, or other Services.

Some features of the Services may require you to provide certain personal information. You may elect not to provide this information, but doing so may prevent you from using or accessing those features.

 

Information Collected Through Our Website and Online Store

When you visit or interact with our website or online store, we or our service providers may collect information such as browser type, IP address, device identifiers, pages viewed, referring and exit pages, interactions with website content, transaction information, and similar online activity information.

We may use cookies, pixels, tags, web beacons, analytics tools, advertising technologies, software development kits, scripts, and similar technologies (collectively, “Online Tracking Technologies”) to operate the website and online store, remember preferences, understand how visitors interact with our Services, measure performance, support security and fraud prevention, provide customer support, and, where enabled and permitted, help tailor advertising or marketing on our Services or other websites.

Some Online Tracking Technologies are necessary to operate the website or online store, process transactions, maintain security, or provide features you request. Other Online Tracking Technologies, such as certain analytics or advertising technologies, may be optional or may require consent depending on applicable law and the available preference tools.

Where required by applicable law, we will not intentionally activate optional analytics or advertising Online Tracking Technologies until you have provided the required consent through available cookie or privacy preference tools. If you reject optional Online Tracking Technologies through an available preference tool, we will use reasonable measures designed to honor that choice for the applicable browser or device, subject to technical limitations and lawful exceptions.

Our website is supported by Shopify privacy tools and/or privacy preference tools that are designed to recognize and process Global Privacy Control (“GPC”) signals where required by applicable law. If we receive and are able to process a valid GPC signal, we will treat it as a request to opt out of the sale or sharing of personal information or targeted advertising for the browser or device associated with the signal, as required by applicable law. Because GPC is browser- and device-specific, you may need to enable GPC on each browser or device you use.

Because our website and online store may be supported by Shopify or other third-party service providers, those providers may collect and process certain information through their own technologies and pursuant to their own privacy practices when they provide services to us or when they process information for their own purposes. Information Collected Through the RoadTech App

When you download, access, or use the App, we may collect certain information through or in connection with the App, including:

·      Usage details, such as your access to and use of the App, traffic data, logs, interactions with App features, and other communication data;

·      Device information, such as your mobile device type, unique device identifier, IP address, operating system, browser type, mobile network information, and similar technical information;

·      Account, subscription, and support information submitted through the App;

·      Product pairing information and information necessary to connect the App with RoadTech products; and

·      Product or vehicle-related information transmitted to the App from RoadTech products or RTC Services.

The App may allow you to enter or upload information relating to your RV, product configuration, subscriptions, or customer support requests.

 

Mobile Device Location

The App does not collect or use the precise location of your mobile phone or mobile device for tracking purposes. However, if you subscribe to connected services, vehicle location data collected by a connected RoadTech device may be transmitted to the RoadTech Connect platform and displayed through the App as described in our Vehicle Data Transmission Policy [link] and Connected Services Policy [link].

For clarity, vehicle location data collected by a RoadTech Connect device is different from mobile phone location data collected directly from your mobile device. We do not use your mobile phone’s GPS location to track you through the App unless we first disclose that practice and obtain any consent required by applicable law.

 

Stored Information and Files on Your Mobile Device

The App is not intended to broadly access files stored on your mobile device, such as photos, videos, audio files, or documents, except where you choose to provide, upload, or transmit such information through an App feature, or where access is necessary for an App feature that you enable and for which any required device permission is obtained.

 

Information Collected Through RoadTech Products and RTC Services

If our products collect information about you, your product, or your vehicle, such information may be stored only in the product unless you have purchased or enabled a product designed for connection to a mobile application, cellular network, or networked service.

If you have purchased or enabled a connected device, please see our Vehicle Data Transmission Policy [link] and Connected Services Policy [link] for more detailed information regarding the collection and use of information with respect to that device.

By using RoadTech products and RTC Services, you acknowledge that RoadTech and its affiliates may collect, use, and own data arising from the operation and use of our products and RTC Services as follows:

·      Sensitive Information. Data that may be used to identify you personally when combined with other information, such as geolocation information, VIN, IP addresses, MAC addresses, and device IDs, is treated as potential personal information and will be collected, used, and shared only in accordance with our privacy policies and applicable laws.

·      Product Usage Data. Our RoadTech products may collect information about their performance and usage. RoadTech may collect and analyze this usage data to improve our products, develop new features, and ensure quality and safety.

 

Information We Obtain from Third Parties

We may obtain information about you from third parties in connection with the Services, including vendors, service providers, affiliates, resellers, distributors, RV OEMs, RV dealers, payment processors, ecommerce platforms, analytics providers, advertising partners, and customer support providers.

 

5.        How We Use Personal Information

We may use personal information for the following purposes:

 

Providing Products and Services

We use personal information to provide, operate, support, and improve the Services, including to process orders and payments, provide subscriptions, create and manage accounts, pair RoadTech products with the App, transmit RTC Unit Data and Sensor Data where applicable, display product or vehicle-related information through the App, provide customer support, fulfill orders, and deliver products and services you request.

 

Account, Subscription, and Billing Administration

We may use personal information to administer your account or subscription, provide expiration and renewal notices, process billing and collection, provide order confirmations, manage subscription status, and enforce our rights under applicable agreements.

 

Communications

We may use personal information to communicate with you about your account, subscription, products, services, support requests, updates, changes to our terms or policies, App updates, product notices, customer service matters, and other service-related communications.

 

Product Support, Safety, and Service Improvement

We may use personal information, product usage data, Sensor Data, RTC Unit Data, and related information to provide product support, improve product performance, develop new features, troubleshoot issues, analyze product use, improve quality and safety, and maintain our business relationship with you.

 

Website Analytics, Advertising, and Marketing

We may use personal information and online activity information to understand how visitors use our website and online store, measure the effectiveness of our Services and communications, improve our website, provide relevant content, and, where enabled and permitted, support advertising or marketing activities. Certain advertising or marketing activities may involve disclosing or making available online activity information, identifiers, commercial information, or similar information to advertising, analytics, ecommerce, or marketing partners.

Where required by applicable law, we will provide applicable choices or obtain applicable consent before using personal information for targeted advertising, cross-context behavioral advertising, or other activities requiring consent or opt-out rights.

 

Security and Fraud Prevention

We may use personal information to detect, investigate, prevent, or take action regarding possible fraudulent, theft, unauthorized, illegal, malicious, or unsafe activity, including to protect the rights, property, or safety of RoadTech, our customers, service providers, and others.

 

Legal and Compliance Purposes

We may use personal information to comply with applicable laws, regulations, legal processes, and governmental requests; enforce our agreements; maintain records; and establish, exercise, or defend legal claims.

 

With Your Consent or Direction

We may use personal information for other purposes disclosed to you when you provide the information, or with your consent or direction, including when you choose to share certain information with your RV OEM or RV dealer.

 

6.        How We Disclose Personal Information

We may disclose personal information as described below.

 

Service Providers and Vendors

We may disclose personal information to vendors, service providers, contractors, and other third parties who perform services on our behalf, such as website hosting, ecommerce hosting, IT services, mobile application development and hosting, cloud vehicle data analytics, cloud storage, payment processing, order fulfillment, customer support, communications, security, analytics, and similar services.

 

Payment Processors

We use Stripe and may use other third-party payment processors to process payments. We do not access or store complete payment card information. Stripe’s privacy practices apply to certain data collected and used in connection with processing your payments.

 

Ecommerce and Storefront Providers

To the extent our website, online store, or subscriptions are provided through a Shopify-hosted storefront or similar ecommerce provider, the provider’s privacy practices may also apply to certain data collected through that storefront. These providers may collect and process personal information to provide ecommerce functionality, process orders, support fraud prevention, improve storefront functionality, and provide other services described in their privacy notices.

 

Analytics, Advertising, and Marketing Partners

We may disclose or make available certain information, such as identifiers, device information, usage information, commercial information, and online activity information, to analytics, advertising, ecommerce, and marketing partners. These disclosures may support analytics, measurement, advertising, marketing, attribution, audience development, or similar activities, subject to applicable law and any available privacy choices.

Depending on where you reside and how these technologies are configured, these activities may be considered a “sale,” “sharing,” or processing for targeted advertising under applicable privacy laws. Where required, you may have the right to opt out of those activities, as described in this Privacy Policy and any applicable cookie or privacy preference tools.

 

RV OEMs and RV Dealers

When you direct, request, enable, or otherwise consent to our disclosure of certain information to an RV OEM or RV dealer, we may disclose information to those parties to allow them to provide service, support, product improvement, warranty support, sales performance analysis, or other services or communications that you have enabled or requested.

 

Aggregated, De-Identified, or Anonymized Information

We may disclose aggregated, de-identified, or anonymized information that is designed and reasonably maintained not to identify an individual or specific vehicle, subject to applicable law. For example, we may compile statistics on average tire pressures or sensor performance across many users to share with a vehicle manufacturer or to improve our products, but these statistics would not include your name, contact information, location, location history, or a direct association with your vehicle.

We will not attempt to re-identify information that we maintain as de-identified except as permitted by applicable law, such as to determine whether our de-identification processes satisfy applicable legal requirements.

 

Data Sharing with Partners

With appropriate user and/or dealer consent where required, RoadTech may share or license aggregated, de-identified, or anonymized product data with third parties, such as OEMs, industry researchers, or analytics partners, for purposes such as improving vehicle safety, product development, or analysis of industry trends. We do not disclose personally identifiable information to these partners without your consent.

 

Corporate Transactions

We may disclose personal information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, bankruptcy, liquidation, or other sale or transfer of some or all of RoadTech’s assets, whether as a going concern or as part of another proceeding, in which personal information held by RoadTech about users of the Services is among the assets transferred.

 

Legal, Safety, and Enforcement Purposes

We may disclose personal information to comply with any court order, law, regulation, legal process, or governmental request; to enforce our rights arising from contracts entered into between you and us, including the App End User License Agreement and applicable Privacy Center policies; for billing and collection; or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of RoadTech, our customers, service providers, or others.

 

Sale, Sharing, and Sensitive Personal Information

We do not sell personal information for money. However, some disclosures or uses of Online Tracking Technologies, advertising technologies, analytics technologies, or ecommerce technologies may be considered a “sale,” “sharing,” or processing for targeted advertising under certain privacy laws. Where those laws apply, we provide applicable rights and choices, including any available opt-out mechanisms described in this Privacy Policy and any applicable cookie or privacy preference tools.

Other than as described in this Privacy Policy, applicable Privacy Center policies, or applicable notices, we do not knowingly sell or share personal information with marketers, data brokers, or other third parties. We do not use or disclose sensitive personal information without your consent or for the purpose of inferring characteristics about you, except as permitted by applicable law.

 

7.        Third-Party Websites, Apps, Platforms, and Links

The Services may provide links to websites, apps, platforms, or online services operated by third parties. If you subscribe to RTC Services, we may provide you with links to RV OEMs, RV dealers, or third-party resellers, such as Amazon or TechnoRV.

Our websites and apps, and these third parties, may have their own privacy policies, which we encourage you to read before providing information on or through them. If you follow links to sites, apps, or platforms not affiliated with or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such third-party sites, apps, or platforms, including the accuracy, completeness, or reliability of information found on them. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.

If you access our website or online store at roadtechconnect.com from or through the App, this Privacy Policy will apply with respect to your interaction with our website and online store, subject to any additional terms, notices, or third-party privacy practices applicable to that website or storefront.

 

8.        SMS Communications

By providing your mobile phone number and opting in to receive SMS/text messages (“Opt In”), you consent to receive text messages from RoadTech. This may include order updates, account notifications, shipping alerts, product support messages, and customer service communications.

By Opting In, you may receive:

·      Transactional messages;

·      Product or service-related alerts or support messages; or

·      Customer service communications.

You authorize RoadTech to use autodialer or non-autodialer technology to send text messages to the mobile phone number associated with your Opt In. You do not have to Opt In or agree to Opt In as a condition of purchase.

You may cancel the SMS service at any time by texting STOP (“Opt Out”). After doing so, you will no longer receive SMS messages from us. You may restart text communications by texting START or SUBSCRIBE to our most recent message. If you need assistance, text HELP and we will respond within a reasonable time.

By Opting In, you confirm that you are authorized to use the mobile phone number provided. RoadTech will use reasonable commercial efforts to deliver SMS messages but is not liable for delayed or undelivered messages. Message frequency may vary. Message and data rates may apply depending on your mobile plan.

SMS consent and mobile numbers are not shared, sold, or disclosed to third parties or affiliates for marketing or promotional purposes without your consent. SMS consent is not shared with third parties. We only use your mobile number to send messages as described above or as otherwise permitted under this Privacy Policy.

 

9.        Security and Retention of Personal Information

We have implemented measures designed to secure personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Payment transactions are processed by our third-party payment processor, such as Stripe.

The safety and security of your information also depends on you. Where we have given you, or where you have chosen, a password for access to certain parts of the Services, you are responsible for keeping that password confidential. Please do not share your password with anyone.

Unfortunately, transmission of information via the internet, mobile platforms, cellular networks, and connected devices is not completely secure. Although we take measures designed to protect personal information, we cannot guarantee the security of personal information transmitted through the Services. Any transmission of personal information is at your own risk.

We will retain personal information only for as long as necessary to fulfill the purposes for which we collected it, as described in this Privacy Policy, unless a longer retention period is required or permitted by law. In determining retention periods, we consider the nature of the information, the purposes for processing it, the potential risk of harm from unauthorized use or disclosure, and applicable legal requirements.

Once we have no ongoing legitimate business need or legal obligation to retain personal information, we will either delete it or anonymize it. Except for data in active use by subscribers, certain RTC Services data that we collect from you may be permanently de-identified or anonymized after one year. Once we de-identify or anonymize information, we cannot use that data alone to identify you.

 

10.  Ownership of Product and Services Data

Except for personal information, all data generated by or collected from RoadTech products and RTC Services is owned by RoadTech. We reserve the right to use such data, in compliance with this Privacy Policy and applicable law, for our legitimate business purposes. For the avoidance of doubt, product usage data and data from RoadTech products that have been de-identified or aggregated does not constitute personal information and remains the property of RoadTech.

 

11.  Your Privacy Rights and Choices

Depending on where you live, you may have some or all of the following rights in relation to your personal information:

·      Right to access or know;

·      Right to delete;

·      Right to correct;

·      Right to data portability;

·      Right to opt out of sale or sharing;

·      Right to opt out of certain targeted advertising or profiling where applicable;

·      Right to withdraw consent or stop certain optional processing, where applicable;

·      Right to manage communication preferences; and

·      Right to appeal certain privacy request decisions.

These rights are not absolute, may apply only in certain circumstances, and, in certain cases, we may decline your request as permitted by law.

You can review and change certain personal information by logging into the App and visiting your account profile page, where available. You may also send us an email at customerservice@roadtech.com to request access to, correction of, deletion of, or a copy of personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

To opt out of sharing certain RTC Unit Data and Sensor Data with RV OEMs or RV dealers, please visit our Opt-Out of Data Transmission Policy [link] for more information. This opt-out is separate from any rights you may have to opt out of the sale or sharing of personal information or targeted advertising under applicable privacy laws.

California Privacy Rights; Sale, Sharing, and Targeted Advertising Choices

If you are a California resident or a resident of another state with similar rights, you may have the right to opt out of the sale or sharing of personal information or the use of personal information for targeted advertising, as those terms are defined by applicable law.

You may exercise this right by using our cookie or privacy preference tool, clicking “Do Not Sell or Share My Personal Information” where available, or by contacting us at customerservice@roadtech.com.

Our website is supported by Shopify privacy tools and/or privacy preference tools that are designed to recognize and process GPC signals where required by applicable law. If we receive and are able to process a valid GPC signal, we will treat it as a request to opt out of the sale or sharing of personal information or targeted advertising for the browser or device associated with the signal, as required by applicable law. Because GPC is browser and device-specific, you may need to enable GPC on each browser or device you use.

Nevada provides its residents with a limited right to opt out of certain personal information sales. Nevada residents who wish to exercise sale opt-out rights may submit a request to customerservice@roadtech.com. 12.   International Users

We are a company based in the United States, and your personal information may be transferred to and processed in the United States regardless of where you are located. In addition, we may transfer, store, or process information in other countries where we or our service providers maintain facilities or business operations. The data protection laws of these countries may differ from those in your country of residence. By using the Services or providing us with your information, you acknowledge that your information may be transferred to and processed in jurisdictions outside of your home country.

 

13.  Relationship to Shopify, Stripe, and Other Third-Party Providers

To the extent our Services are provided through a Shopify-hosted storefront or similar ecommerce service, that provider’s privacy practices may also apply to certain data collected through the storefront. For specific information about cookies related to powering stores with Shopify, please see Shopify’s cookie documentation at https://www.shopify.com/legal/cookies.

We use Stripe and may use other third-party payment processors to process payments. Stripe’s privacy practices apply to certain data collected and used in connection with processing payments. Stripe’s privacy center is available at stripe.com/legal/privacy-center.

Other third-party providers, such as analytics, advertising, marketing, ecommerce, communications, hosting, app development, and customer support providers, may process personal information in connection with the Services as described in this Privacy Policy and their applicable privacy notices.

In the event of any conflict between this Privacy Policy and the privacy policies of Shopify, Stripe, or other third-party providers, this Privacy Policy will govern with respect to personal information collected by or on behalf of RoadTech, and the third-party provider’s policy will govern with respect to information collected by that third party for its own purposes.

These RoadTech Connect terms and conditions (“RTC Terms”) supplement and incorporate by reference our store and website terms of service (link).  Our store and website terms of service describe your rights and responsibilities when you use the Services. 

These RTC Terms further describe your rights and responsibilities when you use our RoadTech products and platforms, and with respect to certain of our Services provided by subscription through our RoadTech Connect platform or RoadTech App (collectively, the "RTC Services”).

Please read these RTC Terms carefully. By using or accessing the RTC Services, you agree to be bound by these RTC Terms. If you do not agree to these RTC Terms, please do not use or access the RTC Services.

 

1.        Access and Account

By agreeing to these RTC Terms, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the RTC Services on devices you own, purchase or manage.

To access or subscribe to, the RTC Services (depending on RoadTech product), you may be asked to set up an account and provide certain information, such as your name, email address, billing, payment, and vehicle information. 

As with our store and website accounts, you represent and warrant that all the information you provide to us is correct, current and complete and that you have all rights necessary to provide this information.

 

2.        Definitions

Capitalized terms used in our store and website terms of service apply here.

Capitalized terms used in our Vehicle Data Transmission Policy (link) and our Connected Services Policy (link) also apply here.

Further terms used in these RTC Terms bear the meanings set forth below or are separately defined in the section to which they primarily pertain.  

Firmware” means all computer code embedded in or otherwise installed or running in a Unit, and any improvements, developments, modifications, patches, updates, and upgrades thereto that RoadTech develops or provides.

Portal” means a browser-based service provided by RoadTech through which RV OEMs and RV Dealers may access and view information related to the Units and the recreational vehicles on which they are installed.

Subscriber” means an RV OEM, RV Dealer or RV end user who has subscribed to an RTC Service, whether to the Portal or through the RoadTech App.

Unit” means a self-contained hardware unit branded with a RoadTech trademark, trade name or logo, including a chassis, all hardware physically contained within the chassis and all included Firmware, antennae and mounting hardware and related wiring.

 

3.        RTC Services

We have made every effort to provide an accurate representation of our RTC Services. 

All descriptions of RTC Services are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any RTC Services at any time and may limit the access to any person, geographic region or jurisdiction, on a case-by-case basis.

 

4.        Subscription

When you subscribe to RTC Services, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason at its discretion. We must receive confirmation that your payment has been successfully processed before your order is accepted.

RV end users may access RTC Services by subscribing through the RoadTech App. The RoadTech App is subject to a separate end user license agreement (EULA).

RV OEMs and RV Dealers may subscribe to the RTC Portal by contact RoadTech directly.  RV end users do not have access to the RTC Portal. 

 

5.        Prices and Billing

Subscription prices, discounts and promotions are subject to change without notice. 

You agree to provide current, complete and accurate purchase, payment and account information for all subscriptions. 

 

6.        RoadTech App

All RTC Services for RV owners are provided through the RoadTech App.

 

7.        Privacy

All personal information that we collect through RTC Services is subject to our RTC Privacy Policy (link).

Our Vehicle Data Transmission Policy (link) provides more detailed information about how our RoadTech products collect and transmit data from your RV or light-duty trailer. 

Our Connected Services Policy (link) provides more detailed information about how e collect, use, and disclose your personal information when you subscribe to our RTC Services using our RoadTech App on your mobile device. Our Connected Services Policy also describes how our RoadTech Connect Platform communicates with our RoadTech products.

The RTC Privacy Policy, Vehicle Data Transmission Policy and Connected Services Policy are each incorporated into these RTC Terms.

 

8.        Product Sales

Sales of products through our website are governed by store and website terms of service.

If you purchased an RV with our product already installed, then we assume that title to our product passed to you along with title to the RV.

RoadTech and its licensors exclusively own all intellectual property rights in the Units. Sale of Products does not include sale of Firmware. Sale of products does not include sale of Firmware. All Firmware is licensed to the purchaser under the terms of the applicable Firmware License, not sold.

 

Installation & Configuration

Products must be installed according to the applicable, then-current installation and configuration procedures published by RoadTech.

 

Warranty and Returns

For products purchased through our store, please refer to store and website terms of service for returns and refunds.

All products sold are subject to RoadTech’s Hardware Warranty (link).  For products conveyed to you along with your RV purchase, our RMA Policy (link) governs the warranty return process. 

 

Firmware

The Firmware is licensed, not sold. RoadTech retains ownership of the Firmware, including all intellectual property rights therein and thereto. RoadTech reserves all rights in the Firmware not expressly granted hereunder.  Portions of the Firmware, including but not limited to the source code and the specific design and structure of individual modules or programs, constitute or contain trade secrets of RoadTech and its licensors.

 

Firmware License

RoadTech hereby grants to the RV OEM, RV Dealer and you, the RoadTech product owner, a royalty-free, worldwide, non-exclusive license to activate and use the Firmware solely as embedded, installed or running on the Unit for which it was originally provided by RoadTech, according to RoadTech’s published instructions for use, unless the Unit is replaced pursuant to the Hardware Warranty Policy and RMA Policy (“Firmware License”). The Firmware License is transferable only to subsequent owners of the Unit on which Firmware is embedded.

 

9.        Improvements & Updates

RoadTech continuously improves its products, and may from time to time (i) update Firmware and cause Firmware updates to be automatically installed onto Units; (ii) update the Apps; or (iii) make available newer models of Units. RoadTech may deploy over-the-air (OTA) updates, patches, and configurations.  If you block RoadTech from doing so, you may not be able to obtain certain warranty or recall protections.

 

10.  Recall.

We will notify you of any safety, compliance, or quality issues that could reasonably lead to a recall or necessitate preventative action. If we decide to recall a product, then RoadTech will provide written notice of the recall to you. RoadTech will cover the costs of shipping and repairing or replacing recalled product.

 

11.  Prohibited Conduct. 

You may not do any of the following:

Reverse Engineering

You may not, nor will you permit any representative or third party to reverse engineer, disassemble, or attempt to derive the source code or underlying ideas of any Unit or other RoadTech technology. 

Benchmarking

You may not publish, disclose, or otherwise make public any performance, reliability, accuracy, or other benchmark results relating to the Unit or other RoadTech technology. 

Tampering

You may not modify, service, or otherwise tamper with any Unit or other RoadTech technology.  All modification and servicing must be performed by RoadTech or its designee.

 

12.  Data

Definitions

Customer Data” means data provided by an RV end user to RoadTech in connection with RTC Services.

Dealer Data” means data provided by an RV Dealer to RoadTech.

OEM Data” means data provided by a manufacturer to RoadTech. 

Unit Data” means data that identifies a Unit (such RTC Unit ID or TPMS Unit identification number) and data generated by a Unit (such as GPS and movement data).

Usage Data” means any anonymized, de-identified, and/or aggregated data and/or publicly available information relating to Customer’s use of the Products.

  

Ownership

The RV OEM will remain owner of OEM Data. The RV Dealer will remain owner of Dealer Data. 

Each of RV OEM and RV Dealer hereby grant to RoadTech a fully-paid up, royalty-free, worldwide, transferable, sublicensable, perpetual license to use, disclose, copy, transform, make derivative works of, aggregate, sell, lease, use for training train machine learning or other artificial intelligence models, rent, transfer or otherwise exploit all RV OEM data and RV Dealer Data provided to RoadTech through the Portal.

You, the RV end user, hereby grant to RoadTech a limited license to use Customer Data to provide RTC Services to you and to share Customer Data with third parties at your direction.

RoadTech is and will at all times remain the sole owner of all Usage Data, Unit Data and Sensor Data, subject to applicable privacy laws.  RoadTech hereby grants to each Subscriber a perpetual license to view, copy and use Usage Data, Unit Data and Sensor Data as may be provided to such Subscriber during the applicable subscription term, subject to applicable privacy laws, and solely for Subscriber’s internal business or personal purposes, as the case may be. 

 

13.  Portal

Use of the Portal is subject to our store and website terms of service.

 

14.  Location and Restricted Use

RoadTech does not warrant connectivity or availability of RTC Services outside of the continental United States.

In addition to other disclaimers in our store and website terms of service, the following disclaimers apply:

EXCEPT TO THE EXTENT EXPRESSLY PROVIDED IN ROADTECH’S PRODUCT WARRANTY, THE FIRMWARE, PORTAL AND ROADTECH TECHNOLOGY ARE PROVIDED “AS IS” AND “WITH ALL FAULTS,” AND ROADTECH DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT) TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Vehicle Data Transmission

Our RoadTech TPMS system and RoadTech Connect system (or RTC system) each include RV-mounted units that contain unique identifiers and generate data that we use to provide you with information about your RV.  We also use that information to provide you with our services.  

For information regarding our website, storefront, transactions, and general data practices, please see the Privacy Policy and Terms of Service available in the footer of our website.

 

Definitions

Here is how we define certain terms:

RV” means recreational vehicle, whether self-propelled or towable.  If you install our products on a light trailer, then we consider your light trailer to be an RV for purposes of our privacy and data policies.

RV Dealer” means a retail RV seller and service provider.

RV OEM” means the manufacturer of the RV on which the RTC Unit is installed.

RTC Unit” means RoadTech’s telematics hardware that collects, stores and transmits RV location and health data.

RTC Unit ID” means, collectively, the serial number, IP address, MAC address and/or IMEI number assigned to the RTC Unit.

RTC Unit Data” is data generated by sensors onboard the RTC Unit, and includes geolocation (GPS), temperature, motion and orientation (leveling) data.  

Sensor Data” means data collected from sensors connected to an RTC Unit, TPMS Unit or TMPS Connect Unit, as the case may be, and may include unique identifiers assigned to the sensor by the sensor manufacturer. 

TPMS Unit” means RoadTech’s hardware that collects tire pressure data and transmits the tire pressure data to a local display. 

TPMS Connect Unit” means RoadTech’s hardware that collects, stores and transmits tire pressure data and, depending on model, temperature data. 

Other terms are defined below.

 

1.        RoadTech TPMS

Our TPMS products include the RoadTech TPMS system and the RoadTech TPMS Connect system, which each provide real-time tire pressure and temperature monitoring for your RV.

 

RoadTech TPMS System

The RoadTech TPMS system includes a display for mounting to an RV, a repeater, a set of sensors, and installation components. Your RV manufacturer or dealer may have installed the RoadTech TPMS system on your RV.  Or, the RoadTech TPMS system may have been installed on your RV by you or someone else as an aftermarket kit.

The RoadTech TPMS system collects Sensor Data (tire pressure only) from the TPMS Unit and displays the tire pressure on a locally-connected display. The RoadTech TPMS system cannot be connected to the RoadTech App.

The RoadTech TPMS system does not collect or store any personal information, or transmit any data to us.  We do not have remote access to the TPMS Unit or to any data from the RoadTech TPMS system.

 

RoadTech TPMS Connect System

As with the RoadTech TPMS system, your RV manufacturer or dealer may have installed the RoadTech TPMS Connect system on your RV.  Or, the RoadTech TPMS Connect system may have been installed on your RV by you or someone else as an aftermarket kit.

Unlike the RoadTech TPMS system, however, the RoadTech TPMS Connect system requires use of the RoadTech App.  You must create a user account using the RoadTech App and associate your vehicle in order to view Sensor Data from your RoadTech TPMS Connect system.  Your RoadTech App will search for the MAC address of your TPMS Connect Unit and allow you to link the TPMS Connect Unit to your account through a Bluetooth® connection.  You must be near the RoadTech TPMS Connect system in order for your RoadTech App to detect the TPMS Connect Unit.

Once the TPMS Connect Unit is linked to your RoadTech App, then the RoadTech App will display “live” or real-time tire pressure and, if included, temperature data sent by the TPMS Connect Unit.  

When your RoadTech App is open and connected to your RoadTech TPMS Connect system, the RoadTech App will send to us tire pressure and temperature data from your RoadTech TPMS Connect system.  We store the tire pressure and temperature data transmitted to us by your RoadTech App, and use your TPMS Connect Unit’s MAC address to link that data to your account in our system.

If you only have a basic user account, then the RoadTech App will not show you any tire pressure or temperature history from your RoadTech TPMS Connect system.  In order to view historical data from your RoadTech TPMS Connect system, you must upgrade your user account to a RoadTech Connect platform account.

The RoadTech TMPS Connect system does not include a local display.  You may separately purchase a display for local connection to your TPMS Connect Unit.  You may use a local display for your RoadTech TPMS Connect system if you would like to see your vehicle’s tire pressure data without using the RoadTech App.

If you also have a RoadTech Connect system for which you have set up a RoadTech Connect platform account with us through the RoadTech App, then you may associate your RoadTech TPMS Connect system with that RoadTech Connect account.  If you associate your RoadTech TPMS Connect system with your RoadTech Connect account, then we will have access to your TPMS data under the same conditions that we have access to data from your RTC system.

2.        RoadTech Connect

Our RV health product is the RoadTech Connect system, which provides location and health telematics for your RV. 

The RoadTech Connect system includes an RTC Unit for mounting in an RV, an antenna, and installation components. Your RoadTech Connect system may also include one or more sensors.  Your RV manufacturer or dealer may have installed the RoadTech Connect system.  Or, the RoadTech Connect system may have been installed as an aftermarket kit.

The RTC Unit has associated IP and MAC addresses listed on the RTC Unit.  The RTC Unit may connect to our RoadTech Platform using cellular communication, and has an associated IMEI number.  The IMEI number is listed on the RTC Unit.

RV OEM 

After an RV OEM installs an RTC Unit on an RV, the RV OEM activates the RTC Unit, which then communicates via cellular communication with our RoadTech Connect platform. The RV OEM then uses the RoadTech Connect platform to link the RTC Unit to the RV based on the RV’s vehicle identification number (VIN). The RV OEM may use the RoadTech Connect platform to track the make, model, floor plan and other RV OEM information about the RV.

Once the RTC Unit is linked to the RV, then the RTC Unit will collect and transmit RTC Unit Data to the RoadTech Connect platform so that the RV OEM can monitor the condition and location of the RV before delivery to an RV Dealer. 

 

RV Dealer 

Upon delivery of the RV to an RV Dealer, the RV will typically travel either to the RV Dealer’s lot or directly to you, the customer who purchased the RV from the RV Dealer.  Because we do not know when an RV has been sold or delivered by an RV OEM, or when a customer might take possession of an RV, we collect and share RTC Unit Data based on RV OEM and RV Dealer geofences and time-based rules.

When an RV leaves the RV OEM geofence, then we will stop sharing further RTC Unit Data with the RV OEM. 

If the RV is delivered to an RV Dealer that uses our RoadTech Connect platform and has agreed to share data with the RV OEM, then RTC Unit Data will be made visible to the RV OEM and RV Dealer when the RV reaches the RV Dealer geofence.  Both the RV OEM and RV Dealer will be able to see the status and location of the RV during transit from the RV OEM to the RV Dealer.  

Once inside the RV Dealer geofence, then the RTC Unit Data will continue to be visible to the RV Dealer and to the RV OEM unless the RV Dealer chooses to stop sharing data with the RV OEM. 

We are unable to determine from RTC Unit Data why an RV leaves an RV OEM geofence or an RV Dealer geofence.  We are unable to determine if the RV left for delivery directly to a customer, or because of theft, or for some other reason.  So, when an RV leaves an RV OEM geofence or an RV Dealer geofence, we continue to collect RTC Unit Data for purposes of theft recovery and anti-fraud enforcement.  When the RV leaves the RV OEM geofence or the RV Dealer geofence, we continue to collect RTC Unit Data for thirty days.  Then, for the next thirty days after that, we collect live GPS location data (last known location) for the RV.  We may share RTC Unit Data with the RV OEM and/or RV Dealer to assist with theft recovery and legal enforcement efforts.

 

Customer Use

The RTC Unit primarily collects technical and operational data (such as location and sensor data), which does not directly identify an individual unless linked to account or other identifying information. If you do not connect the RoadTech Connect system to the RoadTech App or subscribe to our platform services, then RTC Unit Data may be retained locally on the device and will not be transmitted to RoadTech systems except as described above.

If the RTC app is installed on your mobile device, then you may connect to your RV’s RTC Unit to the RV Unit using a BlueTooth® connection only for installation and pairing purposes. You must be near the RoadTech RoadTech Connect system in order for your RoadTech App to detect the RTC Unit.

To access data from your RTC Unit, you must create a RoadTech Connect platform account and connect to your RTC Unit using your RV VIN.  

If the RTC Unit was installed by an RV OEM or RV Dealer registered to use our RoadTech Connect platform, then your RTC Unit Data will be linked to a RV VIN already existing in our RoadTech Connect platform.  You may choose to share RTC Unit Data with the RV OEM and RV Dealer, as described in our Connected Services Policy [link].

If the RTC Unit was installed by you or by someone else, then you may link your RTC Unit to your RoadTech Connect account by using an RTC Unit ID as prompted by the RoadTech Connect platform.

The RTC Unit collects, stores and transmits RTC Unit Data and Sensor Data to the RoadTech Connect platform.

Connected Services Policy

As described in our Vehicle Data Transmission Policy [link], our RoadTech TPMS system and RoadTech Connect system (or RTC system) each include RV-mounted units that contain unique identifiers and generate data that we use to provide you with information about your RV.  We also use that information to provide you with our services.

Certain terms used in this Connected Services policy are defined in our Privacy Policy [link] or Vehicle Data Transmission Policy [link]. This Connected Services Policy describes how data is used and shared through our Services. For additional information about how we collect and process personal information, please see our Privacy Policy.

 

1.        RoadTech App

Our RoadTech App can be used with either or both of the RoadTech TPMS system and RoadTech Connect system.  

 

RoadTech TPMS

You may use the RoadTech App for the RoadTech TPMS system without subscribing to our RoadTech Platform services.

 

RoadTech Connect

To use the RoadTech Connect system, you must subscribe to our RoadTech Platform services.  To subscribe to our RoadTech Platform services, you must provide your name, contact information and financial information.

You may also provide to us one or more addresses corresponding to storage location for your RV, preferred dealer name and address, user preferences and other personal information.  You may also provide us with information about your RV, such as VIN, make, model, modifications, settings, and the like (collectively, “Your RV Information”).

Please keep in mind that some information that you provide, such as RV VIN, might be the same as information separately provided by a third party, such as an RV OEM or RV Dealer.  Such information might be both Account Data and third-party data Such information may be treated as both Account Data and third-party data, and each party retains its respective rights in that information in accordance with applicable agreements and policies.  

 

2.        RoadTech Connect Platform

The RoadTech Connect Platform is a web-based portal that provides a place for RV OEMs and RV Dealers to track the health and sales performance of their RVs. 

 

Our Services

When you subscribe to RoadTech Platform services, we will activate your RTC Unit and start sharing RTC Unit Data and Sensor Data with you through your RoadTech App. We will use your RV VIN to link your RV’s RTC Unit to your Account Data.

Using your RoadTech App, you will be able to connect to the RoadTech Connect platform and view information about your RV, such as location, temperature, door open/close status, battery levels, and more.

You will also be able to see your historical data for up to one year.  After one year, RV Unit Data and Sensor Data is de-identified or anonymized in accordance with our data retention practices. 

Sharing Identifiable Information

You may choose to share RTC Unit Data and Sensor Data with your RV OEM and one or more RV Dealers that you select.  You may choose to do so for warranty and service purposes, or for any other reason.

During the time that you choose to share RTC Unit Data and Sensor Data, the RV OEM and RV Dealer(s) will be able to see full RTC Unit Data and Sensor Data, including RV location.

Please keep in mind that the RV OEM and RV Dealer(s) will be able to access and save RTC Unit Data and Sensor Data to their systems.  RTC Unit Data and Sensor Data in the possession or under the control of third parties (such as the RV OEM or RV Dealer(s)) is subject to their privacy and data retention policies.

You may choose to stop sharing RTC Unit Data and Sensor Data with third parties at any time. 

If you choose to stop sharing such data, then no further data will be shared with the third parties.  However, they may still have access to data shared with them before you stopped sharing data.  We do not control those with whom you have chosen to share information to delete your information.

Sharing De-Identified Information

If you subscribe to RoadTech Platform services, and choose not to share RTC Unit Data and Sensor Data, then only anonymized RTC Unit Data and Sensor Data will be shared with the RV OEM and the RV Dealer that sold you the RV.  The RV OEM and RV Dealer will not be able to see your location or link your RV to you through the RV Unit ID.

As described in our Connected Services Policy [link], you may choose to share RTC Unit Data and Sensor Data with your RV OEM and one or more RV Dealers that you select.  

You may choose to stop sharing RTC Unit Data and Sensor Data with third parties at any time. 

To stop sharing RTC Unit Data and Sensor Data with third parties, go to your RoadTech App, start by clicking your profile, which can be found at the top left of the app -> Payment, Subscriptions, and Data -> Manage Subscriptions and Data, then slide the “Data Sharing” toggle button to the left.  Important note: Some subscription packages depend on the data sharing option you selected at the time of signup. If you change this setting, you may be prompted to choose a new package that matches your updated data sharing preference.

We will stop data sharing after you slide the toggle button to the left, and complete any package changes.  

Please keep in mind that data shared before you toggled off data sharing may still be accessible to the third parties.

In order to update your preferred dealer and/or alerts shared with your preferred dealer, start by clicking your profile, which can be found in the top left of the app -> Services -> Preferred Dealer -> then you can update your preferences.  To update your preferred dealer, select a new one from the dropdown.  To share alerts with your preferred dealer, ensure that the box next to “Share Alerts with Dealer” is checked.  And un-check this same box to stop sharing alerts.  

If you wish for the RV OEM or RV Dealer(s) to delete any personal information that they may have about you, please contact them directly. For more information about how data is shared and used, please see our Connected Services Policy and Privacy Policy.
